Welcome to Faces On The Wall (the “Service,” “we,” “us”). By accessing or using the Service — including by uploading a photo or adding your face to the wall — you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old (or the minimum digital-consent age in your country, whichever is higher) to use the Service. If you are under 18, you represent that a parent or guardian has reviewed and agreed to these Terms on your behalf. The Service is not directed to children under 13, and we do not knowingly collect their data.

2. The Service; public nature of content

The Service is a public, interactive photo mosaic. Anything you submit — your photo, name, message, hashtags, links, and location — is public and visible to anyone, and may be indexed by search engines, cached, screenshotted, or shared by others. Do not submit anything you are not comfortable making permanently public.

3. Your content and the rights you grant

You retain ownership of the photo and information you submit (“Your Content”). By submitting Your Content, you grant Faces On The Wall a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, adapt, and distribute Your Content for the purpose of operating, promoting, and improving the Service (including in marketing and social media). This license continues for as long as Your Content is on the Service and for a reasonable period afterward for backups and legal compliance.

You represent and warrant that: (a) you own or have all necessary rights and permissions to submit Your Content; (b) if Your Content contains a person’s face or likeness, you are that person or you have that person’s explicit consent; (c) Your Content does not infringe any copyright, trademark, privacy, publicity, or other right; and (d) Your Content complies with these Terms and all applicable laws.

4. Prohibited content and conduct

You agree not to submit or do anything that is:

Someone else’s photo without their consent, or a photo of a minor other than with verifiable guardian consent;
Sexual, nude, pornographic, or sexually suggestive; violent, gory, or depicting weapons used unlawfully;
Hateful, harassing, defamatory, threatening, or promoting discrimination or violence;
Impersonating another person or entity, or misrepresenting your affiliation;
Infringing intellectual property, or unlawful, fraudulent, or deceptive;
Spam, malware, scraping, bot-driven, or an attempt to disrupt or overload the Service.

5. Moderation and removal

We may, at our sole discretion and without notice or liability, review, refuse, remove, or disable any content or account for any reason, including suspected violation of these Terms. We are not obligated to monitor content but may do so. Automated moderation is imperfect and does not guarantee that all prohibited content is caught or that permitted content is preserved.

6. Reporting and takedowns (DMCA)

If you believe content infringes your copyright or was posted without your consent (including a photo of you), contact us at legal@facesonthewall.com with: a description of the content and its location on the wall, your contact information, a statement of your good-faith belief, and, for copyright claims, a statement under penalty of perjury that you are authorized to act. We will remove infringing or non-consensual content promptly upon a valid request.

7. Payments (if and when enabled)

Joining the wall is currently free. If we enable paid features (e.g., premium profiles, boosts, sponsored placements, or merchandise), the applicable price and terms will be shown at checkout, and payments are processed by our third-party processor (e.g., Stripe) subject to their terms. Except where required by law, all payments are final and non-refundable. Prices and features may change at any time. You are responsible for any applicable taxes.

8. Optional biometric / face-matching features

Some optional features may analyze facial features of photos (for example, to suggest look-alike matches). These features are strictly opt-in. If you choose to use them, you separately and expressly consent to the processing of facial-geometry data for that purpose. We do not use such data to identify you to third parties or sell it, and you may withdraw consent and request deletion at any time. Where such processing is restricted by law, the feature may be unavailable.

9. Intellectual property of the Service

The Service, including its design, code, branding, and compilation of content, is owned by Faces On The Wall and protected by law. Except for Your Content, you may not copy, scrape, or create derivative works from the Service without our written permission.

10. Third-party links

Profiles may contain links to third-party sites and social accounts. We do not control and are not responsible for third-party content, and your use of third-party services is at your own risk and subject to their terms.

11. Disclaimers

THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE DO NOT VERIFY THE IDENTITY, CONSENT, OR CONTENT OF USERS AND ARE NOT RESPONSIBLE FOR USER CONTENT OR CONDUCT.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FACES ON THE WALL AND ITS OWNERS, OPERATORS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR REPUTATION, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE OR ANY CONTENT. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (a) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (b) USD $50.

13. Indemnification

You agree to defend, indemnify, and hold harmless Faces On The Wall and its owners and operators from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from Your Content, your use of the Service, or your violation of these Terms or any law or third-party right — including any claim that a photo you submitted was posted without another person’s consent.

14. Termination

We may suspend or terminate your access at any time, with or without cause or notice. Sections that by their nature should survive (including 3, 11–13, and 15) survive termination.

15. Governing law and dispute resolution

These Terms are governed by the laws of [Your State/Country], without regard to conflict-of-laws rules. Any dispute will be resolved by binding individual arbitration (not in court and not as a class), except that either party may bring an individual claim in small-claims court. You and Faces On The Wall waive any right to a jury trial and to participate in a class action.
